THIS CONTEST (“Contest”) IS SUBJECT TO FEDERAL, STATE, AND LOCAL REGULATIONS AND LAWS AND VOID OUTSIDE THE UNITED STATES AND WHEREVER PROHIBITED OR RESTRICTED.

THESE OFFICIAL RULES (“Rules”) ARE A LEGALLY BINDING AGREEMENT BY AND BETWEEN YOU AND SPONSOR (AS DEFINED BELOW) AND GOVERN YOUR ENTRY AND PARTICIPATION IN THE CONTEST.

THIS CONTEST IS IN NO WAY SPONSORED, ENDORSED, ADMINISTERED BY OR ASSOCIATED WITH FACEBOOK, INSTAGRAM, TWITTER, OR ANY OTHER SOCIAL MEDIA PLATFORM.

  1. SPONSOR. The sponsor of the Contest (“Sponsor”) and the address at which the Sponsor may be contacted is: Fielding Homes, LLC, 227 West Trade Street, Suite 1000, Charlotte, NC 28202.
  2. ELIGIBILITY.The Contest is open to all legal residents of the United States of America (excluding New York, Rhode Island and Florida) and the District of Columbia (“Contest Territory”) who are 21 years of age or older as of the first day of the Registration Period (as defined below in Section 3). Participation in this Contest constitutes each entrant’s full and unconditional representation of their age, as well as acceptance of these Rules and consent to be contacted by Sponsor by email or telephone. Employees of Sponsor, its parent, subsidiaries, affiliates (including but not limited to Crescent Communities, LLC), and all advertising agencies, printers, promotional agencies and families of each involved in this Contest are not eligible to participate in or win the Contest. Current or former members of any collegiate, international or Olympic basketball teams, or any current or former basketball players for collegiate, semi-professional or professional basketball teams or their coaches are not eligible to participate in or win the Contest. ENTRIES THAT DO NOT INCLUDE ALL REQUESTED INFORMATION (AS DETERMINED BY SPONSOR) WILL BE INELIGIBLE.
  3. HOW TO ENTER. Between February 11, 2017 at 12:00 PM EST and April 2, 2017 at 11:00 PM EST (the “Registration Period”), each person wishing to participate in the Contest may enter online and/or in-person, as further described below. Only participants that have successfully completed one or both of the methods of entry described below during the Registration Period will be considered “Entrants” in this Contest, and an “Entry” is not complete until a participant has provided all requested information through the applicable method of entry, as determined by Sponsor. Sponsor’s computer (or that of its designee for this Contest) is the official time keeping device for entry into the Contest. For purposes of these Rules, all times and days are Eastern Standard Time. The two methods of entry are:
    1. Online Entry: Participants must first visit Sponsor’s Contest website at www.fieldinghomes.com/hornets and provide certain requested information, such as name, address, e-mail address, and telephone number. In addition, Participants may:
      1. Visit Sponsor’s Facebook page at www.facebook.com/fieldinghomes;
      2. Refer friends to the Contest via Facebook that subsequently enter the Contest;
      3. Follow Sponsor on Twitter at www.twitter.com/FieldingHomes;
      4. On Twitter, retweet a tweet by Sponsor on its Twitter account (www.twitter.com/FieldingHomes) and specified by Sponsor as being eligible for entry to the Contest;
      5. Visit Sponsor’s Masons Bend community page on its website at www.fieldinghomes.com/fort-mill-sc/masons-bend-community;
      6. Visit Sponsor’s Paddlers Cove community page on its website at www.fieldinghomes.com/clover-sc/paddlers-cove;
      7. Visit Sponsor on Instagram at www.instagram.com/FieldingHomes;
      8. View Sponsor’s photo gallery at www.fieldinghomes.com/photo-gallery; and
      9. Watch a video specified by Sponsor as being eligible for entry to the Contest posted by Sponsor at www.vimeo.com,
      (each of 3.a.i through 3.a.x, an “Online Entry Method”). Each Entrant may submit up to ten (10) Entries to the Contest using an Online Entry Method as described in this Section 3.a. A maximum of ten (10) Entries per Entrant submitted using an Online Entry Method will be eligible.
    2. In-Person Entry. Participants may visit Sponsor’s Paddlers Cove community in Clover, SC or Masons Bend community in Fort Mill, SC and tour a model home at the applicable community (the “In-Person Entry Method”). Each Entrant that uses the In-Person Entry Method will receive ten (10) Entries to the Contest. A maximum of ten (10) Entries per Entrant submitted using the In-Person Entry Method will be eligible.
    Each Entrant may enter the Contest using one or both of the methods of entry described above. A total of twenty (20) Entries per Entrant (ten Entries using an Online Entry Method and ten Entries using the In-Person Entry Method) will be eligible.
  4. WARRANTIES AND CONSENTS. By completing and submitting an Entry, Entrant: (a) represents and warrants that (i) Entrant has read, and agrees to be bound by these Rules, (ii) based on these Rules, Entrant is eligible to participate in the Contest, (iii) all of the information provided as part of Entrant’s Entry is accurate, does not violate any third party’s legal rights (including without limitation rights of privacy and publicity), and otherwise does not violate applicable law; and (b) consents to the use of Entrant’s name and/or likeness by Sponsor for promotional purposes (whether online, in print or through any other media now known or hereafter developed), without additional compensation or authorization unless prohibited by law.
  5. INSTANT WINNERS. Beginning February 11, 2017 and ending March 31, 2017, a video describing the Contest and displaying one or more of Sponsor’s model homes will play during each of twelve (12) Charlotte Hornets home basketball games held at the Spectrum Center in Charlotte, NC. The video will display the Sponsor’s Contest website and invite attendees of the basketball game to visit the Contest website and enter the Contest. After such videos are played, participants may submit an Entry to the Contest using the Online Entry Method as described above and, upon successfully submitting an Entry, will receive a confirmation email from Sponsor or its designee. Each of the first ten (10) Entrants that present a valid confirmation email to Guest Services at the Spectrum Center during the Charlotte Hornets basketball game as determined by Sponsor or its designee in its sole discretion (each, an “Instant Winner”) will receive one (1) twenty (20) ounce vacuum insulated bottle valued at approximately twenty dollars ($20.00). The odds of being an Instant Winner as described above depend on the speed at which each Entrant submits an Entry using the Online Entry Method and presents a valid confirmation email at Guest Services.
  6. SELECTION OF SEMI-FINALISTS. On April 3, 2017, five (5) Entrants will be selected in a random drawing from among all eligible Entries received by Sponsor (each, a “Semi-Finalist”). Each Semi-Finalist will receive two (2) tickets to attend the Charlotte Hornets home basketball game on April 5, 2017 (the “April 5th Game”), valued at approximately forty-five dollars ($45.00) each, and will participate in the Semi-Final Challenge, as described below in Section 7. The odds of becoming a Semi-Finalist depend on the number of eligible Entries received by Sponsor. Semi-Finalists will be announced on April 3, 2017 before 8:00 PM EST. Each Semi-Finalist will be notified via telephone and/or email and will be given instructions on how to claim their tickets to the April 5th Game. Three (3) attempts will be made to contact a Semi-Finalist within a twenty-four (24) hour period. If a Semi-Finalist fails to respond within such twenty-four (24) hour period, or if an e-mail attempt is consistently returned as undeliverable, or if the selected Semi-Finalist cannot accept or receive the tickets for any reason, or he or she is not in compliance with these Rules, the tickets will be forfeited and an alternate Semi-Finalist may be selected at Sponsor’s discretion.Additionally, each Semi-Finalist may be required to sign and return an Affidavit and Release Form (where legal and applicable) in accordance with Section 11 below.
  7. SEMI-FINALIST CHALLENGE. During the April 5th Game, the Semi-Finalists will be eligible to compete against one another in a free throw challenge (the “Semi-Final Challenge”). The specific rules for the Semi-Final Challenge, including any tie-breaker, will be provided to the Semi-Finalists prior to commencement of the Semi-Final Challenge, and will be determined by Sponsor in its sole discretion. Each Semi-Finalist must be present for the April 5th Game and participate in the Semi-Final Challenge in order to continue in the Contest. In the event the April 5th Game is cancelled or postponed for any reason, the Semi-Final Challenge may be scheduled for an alternate date and at an alternate location, if necessary, at the sole discretion of Sponsor. The Semi-Finalist that wins the Semi-Final Challenge (the “Finalist”) will receive four (4) tickets to attend the Charlotte Hornets home basketball game on April 8, 2017 (the “April 8th Game”), valued at approximately forty-five dollars ($45.00) each, and will be eligible to participate in the Final Challenge, as described below in Section 8.
  8. FINAL CHALLENGE. During the April 8th Game, the Finalist will be eligible to make one (1) attempt to make a “good” shot from half-court (the “Final Challenge”) for a chance to select from either the Housing Credit Prize or the Cash Prize, as described below in Section 9. The Finalist will not be allowed any practice attempts prior to taking the half-court shot. In order for the Finalist’s half-court shot to be considered “good”, the Finalist must release the ball while keeping both feet behind the half-court line, the ball must be a regulation basketball inflated to NBA specifications and the ball must enter the designated basket from above and pass completely through the hoop and net without touching any object (except the rim and/or backboard), any person, the ground or the ceiling before entering the basket, and the shot would be legal and count under NBA rules and regulations. Neither the Housing Credit Prize nor the Cash Prize will be awarded if, in the sole discretion of Sponsor, the half-court shot is not “good”, or if the shot is “good” but the Finalist is deemed ineligible. The Finalist must be present for the April 8th Game and participate in the Final Challenge in order to be eligible to receive either the Housing Credit Prize or the Cash Prize. In the event the April 8th Game is cancelled or postponed for any reason, the Final Challenge may be scheduled for an alternate date at the sole discretion of Sponsor.
  9. PRIZES. If the Finalist’s half-court shot is considered “good” and the Finalist is determined to be eligible to win the Contest under these Rules (both in the sole discretion of Sponsor), the Finalist will deemed to be the “Grand Prize Winner”. The Grand Prize Winner may choose one of the following prizes:
    1. A credit of three hundred fifty thousand dollars ($350,000.00) to be used for the purchase of a new home in one of Sponsor’s communities in which Sponsor is currently offering lots or newly built homes for sale (the “Housing Credit Prize”); or
    2. A cash prize of one hundred thousand dollars ($100,000.00) (the “Cash Prize”).
    The Housing Credit Prize must be used for the purchase of a new home in one of Sponsor’s communities in which Sponsor is currently offering lots or newly built homes for sale, and the purchase agreement for such new home must be fully executed by both Grand Prize Winner and Sponsor during the 2017 calendar year. The Housing Credit Prize may be used only toward the purchase price of the new home. Any portion of the Housing Credit Prize that is not used by Grand Prize Winner will be forfeited by Grand Prize Winner, and will not be awarded in cash, credit, or in any other form. No substitution, cash redemption or transfer of the Housing Credit Prize is allowed, except at the sole discretion of Sponsor. Grand Prize Winner will be responsible for all taxes, insurance, home owners’ association fees, utilities, and other expenses associated with the purchase of the new home.
  10. AWARDING OF PRIZES. The vacuum insulated bottles, Charlotte Hornets home basketball game tickets, the Housing Credit Prize, and the Cash Prize (each, a “Prize” and, collectively the “Prizes”) are nontransferable, nonassignable, nonnegotiable, and not redeemable for cash or credit. All Prizes must be accepted as awarded. Prizes are awarded “AS IS” with no warranty, representation or guarantee, express or implied, in fact or in law, made by Sponsor or for which Sponsor shall be liable, including, without limitation, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. No cash or other substitution may be made, except by Sponsor, who reserves the right (but has no obligation) to substitute a Prize (or a component thereof) with another Prize (or component thereof, including cash) of equal or greater value if a Prize is not available for any reason as determined by Sponsor in its sole discretion. Each recipient of a Prize is solely and fully responsible for any and all costs, fees, taxes, assessments and expenses associated with Prize award, redemption, receipt and use, including, without limitation, all federal, state and local taxes on the Prize. Prizes will be awarded only upon successful verification that all Contest requirements have been met, including, eligibility, age and other claims of/information provided by a potential Prize recipient, as applicable. Unused components of a Prize shall be forfeited and have no redeemable cash value. Each recipient of a Prize must take delivery of an applicable Prize at a time and place specified by Sponsor or the Prize supplier. Each recipient of a Prize waives the right to assert as a cost of winning the Prize any and all costs of verification and redemption or travel to redeem the Prize, if any.
  11. AFFIDAVIT OF ELIGIBILITY. Each Semi-Finalist, the Finalist and the Grand Prize Winner will be required to execute and return to the Sponsor an Affidavit of Eligibility and Liability/Publicity Release (the “Affidavit”) (where permitted and applicable) within twenty-four (24) hours of Sponsor’s request. By completing, signing and returning the Affidavit, each Semi-Finalist, the Finalist and the Grand Prize Winner, as applicable, (a) releases and forever discharges Sponsor, its affiliates and subsidiaries, and their respective advertising and promotional agencies from all claims, demands, damages, actions and causes of action arising out of participation in this Contest or to arise by use of the Prizes, (b) confirms compliance with these Rules, and (c) gives permission to the Sponsor, at its option, to publish or otherwise use, as applicable, each Semi-finalist’s, Finalist’s or Grand Prize Winner’s name, address, photograph, voice and comments, without compensation, in any publicity carried out by the Sponsor or its respective advertising agencies, except where prohibited by law.
  12. TAXES. Any valuation of the Prizes stated above is based on available information provided to the Sponsor. The value of the Prizes will be taxable to Entrants who receive a Prize as income. All federal, state and local taxes and any other costs and expenses associated with the acceptance and/or use of Prizes not specifically provided for in these Rules are solely, as applicable, the responsibility of each recipient of such Prize. Each Prize recipient is solely responsible for reporting and paying any and all applicable taxes. Any Entrants that win $600 or more in Prizes will have income reported to them on IRS Form 1099, as required under IRS rules and a copy of said form will be sent to the IRS. Any Prize awarded above the threshold shall require the applicable Prize recipient to provide the Sponsor with valid identification and a signed Form W-9 with a valid taxpayer identification number or social security number before any Prize will be awarded. Each Entrant must contact his/her own tax advisor for any questions concerning taxes.
  13. PUBLICITY. Except where prohibited by law, participation in the Contest constitutes each Entrant’s consent to Sponsor’s and/or Hornets Basketball, LLC’s (and each of their designees’, successors’ and assigns’) use of his or her name, biography, likeness, voice, photographs, video, opinions, statements, hometown, state and country for promotional purposes in any manner or media (including, without limitation, online), worldwide, in perpetuity, and without further payment, consideration, notice, review or consent.
  14. INDEMNIFICATION. By entering the Contest, ENTRANTS AGREE TO FOREVER RELEASE, INDEMNIFY AND HOLD HARMLESS SPONSOR, HORNETS BASKETBALL, LLC, CHARLOTTE ARENA OPERATIONS, LLC AND EACH OF THEIR PARENT COMPANIES, MANAGING AGENTS, SUBSIDIARIES AND AFFILIATES, AND THEIR RELATED PARTIES, AND EACH OF THE FOREGOING ENTITIES’ RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS OF EACH (COLLECTIVELY, THE “RELEASED PARTIES”) FROM AND AGAINST ANY AND ALL LIABILITY WHATSOEVER FOR ANY CLAIMS, COSTS, INJURIES, LOSSES OR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH ENTRANT’S PARTICIPATION IN THE CONTEST, OR DOWNLOADING OR ACCESSING OF ENTRY MATERIALS, OR THE ACCEPTANCE, POSSESSION OR USE/MISUSE OF ANY PRIZE AWARDED HEREIN, ANY SERVICES PROVIDED BY PARTIES OTHER THAN THE SPONSOR IN CONNECTION WITH THE PRIZE AWARDED, OR PARTICIPATION IN ANY PRIZE-RELATED ACTIVITY (INCLUDING, WITHOUT LIMITATION, CLAIMS, COSTS, INJURIES, LOSSES OR DAMAGES RELATED TO PERSONAL INJURIES, DEATH, DAMAGE TO, LOSS OR DESTRUCTION OF PROPERTY, RIGHTS OF PUBLICITY OR PRIVACY, DEFAMATION OR PORTRAYAL IN A FALSE LIGHT). Entrants further covenant not to sue Sponsor or any of the other Released Parties and hereby acknowledge that neither Sponsor nor any Released Party has made or is in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Contest or the Prizes.
  15. LIMITATIONS OF LIABILITY. The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the Entry process or the Contest; (d) technical or human error which may occur in the administration of the Contest or the processing of Entries; (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from an Entrant’s participation in the Contest or receipt or use or misuse of any Prize; or (f) undeliverable emails. If for any reason an Entrant's Entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Entrant’s sole remedy is another Entry in the Contest at the discretion of the Sponsor.
  16. DISPUTES. Entrants agree that: (a) any and all disputes, claims and causes of action arising out of or connected with this Contest or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the North Carolina courts (state and federal); (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (c) under no circumstances will an Entrant be permitted to obtain awards for, and each Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of the Entrants and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of North Carolina without giving effect to any choice of law or conflict of law rules (whether of the State of North Carolina or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of North Carolina.
  17. TERMINATION; MODIFICATION. In the event Sponsor is prevented from continuing with the Contest as a result of lack of feasibility of the Contest, compromised integrity of the Contest, infection by computer virus, unauthorized intervention, technical failures, or any other causes beyond Sponsor’s control, Sponsor may, within its sole discretion, cancel, terminate, modify, or suspend the Contest. If Sponsor elects to abbreviate the Contest as a result of such an event, Sponsor may award the prizes from among all valid and eligible Entries received up to the time of such event. In no event will more prizes be awarded than stated in these Rules.
  18. GENERAL CONDITIONS. Any individual found to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Rules or in an unsportsmanlike or disruptive manner, at Sponsor’s sole discretion, may be disqualified and SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor’s failure to enforce any term of these Rules shall not constitute a waiver of that provision. Potential Instant Winners, Semi-Finalists, the Finalist, and the Grand Prize Winner may be required to provide Sponsor with proof that he or she is the authorized account holder of the e-mail address associated with their Entry. Proof of submitting Entries will not be deemed to be proof of receipt by Sponsor.
  19. PERSONAL DATA. All personal information collected from an Entrant during the Contest will be held, used and processed by the Sponsor in accordance with its Privacy Policy as posted on Sponsor’s webpage at http://www.fieldinghomes.com/privacy-policy. Entrants must provide all required information for their Entry to be considered eligible.
  20. WINNERS LIST. For a list of the names of each Instant Winner, Semi-Finalist, the Finalist and the Grand Prize Winner (available after the Contest ends) and/or a copy of these Rules, send a hand-printed, self-addressed, stamped envelope to Fielding Homes, LLC, 227 West Trade Street, Suite 1000, Charlotte, NC 28202 within thirty (30) days after the Contest ends.
  21. SOCIAL MEDIA. The Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram, Twitter, or any other social media platform. Each Entrant understands that he or she is providing information to Sponsor and not to Facebook, Instagram, Twitter, or any other social media platform. Each Entrant hereby agrees to release Facebook, Instagram, Twitter and any other social media platform used in connection with the Contest from any and all liabilities arising from the Contest.
